1. Overview

Image Tagger AI (the “Service”) is owned and operated by Actinium Agency (“we”, “us”, “our”). The Service is an online tool that generates image metadata, keywords, descriptions, alt text and related content using artificial intelligence. It is intended for photographers, creators, agencies and businesses who want to streamline metadata production for stock platforms and SEO.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into this agreement. By using the Service, you confirm that you meet these requirements.

3. Accounts & Security

When creating an account, you agree to:

• provide accurate and current information
• keep your login credentials confidential
• be responsible for all activity under your account

We may suspend or terminate accounts that are compromised, inactive for a long period, or used in violation of these Terms.

4. Use of the Service

You agree NOT to use Image Tagger AI to:

• generate illegal, harmful or offensive content
• infringe on copyrights, trademarks, privacy or other rights
• upload images that you do not have the rights or permission to use
• attempt to reverse-engineer or abuse the platform
• interfere with the security, stability or performance of the Service

You are solely responsible for how you use the generated metadata and for ensuring compliance with stock agencies, platforms and applicable laws.

5. Credits, Pricing & Billing

Image Tagger AI uses a credit-based model. Each run (Stock Tagging or SEO & Alt Text) uses a certain number of credits as shown in the app.

• One-time packs: credits are paid upfront and do not expire, unless otherwise specified during purchase.
• Subscriptions: credits renew every billing cycle. Unused credits may, or may not, roll over depending on the plan you choose. Details are shown in the pricing page at checkout.
• Prices are shown in USD (or another supported currency) and may be updated from time to time.

Payments are processed by third-party providers such as Stripe, Paddle or Lemon Squeezy. By purchasing credits or a subscription, you also agree to their terms and policies.

6. Image & Data Processing

Uploaded images are used only to generate metadata and to show previews in your dashboard. We do not claim ownership of your images. You remain the owner of all content you upload.

We may temporarily store or cache images and metadata for technical reasons, but we do not use your content to train our own models. See our Privacy Policy for full details.

7. Intellectual Property

The Image Tagger AI platform, including the UI, code, brand name, logo and documentation, is owned by Actinium Agency or its licensors and is protected by copyright and other laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your own business or personal needs. You may not copy, resell, or create competing services based on our platform.

8. No Warranty

The Service is provided on an “as is” and “as available” basis. We do not guarantee that generated metadata will be accepted by every platform, improve rankings or lead to sales. All decisions based on the output are your responsibility.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, loss of profits or data arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 3 months preceding the event giving rise to the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if:

• you violate these Terms
• your activities create risk or legal exposure for us
• we are required to do so by law or by a platform partner

Upon termination, you lose access to your account and remaining credits, unless required otherwise by local law.

11. Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Service after changes become effective means you accept the new Terms.
